Refund and Cancellation Policy

This Refund and Cancellation Policy explains your rights to cancel your subscription to DrillUp (the “App”) and when you may be entitled to a refund. References to the “App” include both the DrillUp mobile application and the DrillUp web application, however you access the service. This Policy forms part of, and should be read together with, our Subscription Terms and Conditions (the “Terms”). Capitalised terms used but not defined in this Policy have the meaning given to them in the Terms.
DrillUp is operated by Theo Imperiale, Lytchett House, 13 Freeland Park, Wareham Road, Poole, Dorset, BH16 6FA (“we”, “us”, “our”). You can contact us at info@drillup.co.uk.
1. How your subscription works
DrillUp is a subscription service providing football coaching content and related digital materials. There are two subscription options: Monthly and Annual. When you subscribe, you pay £4.99 per month / £49.90 per year (based on the billing period you select) and your subscription will automatically renew at the end of each billing period selected unless you cancel it in accordance with this Policy.
If we offer a free or reduced-price trial: Your subscription begins with a 1-week free trial. Unless you cancel before the trial ends, your subscription will automatically continue and you will be charged in accordance with the billing period set out in the paragraph above.
We will tell you the price, billing frequency and renewal date before you subscribe, and we will confirm these details to you after you subscribe.
2. How to cancel your subscription
You can cancel your subscription at any time. Cancelling stops your subscription from renewing; it does not, by itself, automatically entitle you to a refund of amounts already paid (see Parts A and B below for when refunds apply).
To cancel, you can:

manage or turn off auto-renewal in the ‘Manage Subscription’ tab of the App;

where you purchased through the Apple App Store or Google Play, manage and cancel your subscription through your Apple or Google account (see Part C); or

contact us at info@drillup.co.uk
To stop your next renewal payment, please make sure you cancel at least 24 hours before your renewal date. If you cancel after that point, your cancellation will take effect at the end of your current billing period and you will not be charged again after that.
If you cancel, you will continue to have access to the App until the end of the billing period you have already paid for, unless you are entitled to and receive an immediate refund under this Policy.
Part A – Business subscribers (default position)
This Part A applies to you if you subscribe to DrillUp for purposes relating to your trade, business, craft or profession – for example, if you are a coach using DrillUp’s content as part of your coaching activity. Unless you tell us otherwise (see Part B), we will treat you as a business subscriber.
A1. No general right to a refund
As a business subscriber, you do not benefit from the statutory cancellation and refund rights that apply to consumers. Except where this Part A expressly says otherwise, or where we choose to offer a refund at our discretion, all subscription fees are non-refundable and amounts you have already paid will not be refunded if you cancel part-way through a billing period.
A2. Cancelling future renewals
You may cancel at any time to prevent your subscription renewing, as described in section 2. Cancellation takes effect at the end of your current billing period. You will retain access to the App until then.
A3. Refunds where the service is faulty
Nothing in this Part A affects your rights in respect of digital content or services that are not supplied with reasonable care and skill, or that do not conform to the contract. If there is a problem with the App, please contact us at info@drillup.co.uk and we will work with you to put it right, which may include providing a fix, a replacement or, where appropriate, a refund.
A4. Discretionary refunds
We may, at our absolute discretion, offer a refund or partial refund in individual cases. Doing so on one occasion does not oblige us to do so on any other occasion and does not affect the default position that subscription fees are non-refundable.
Part B – Consumer subscribers
This Part B applies to you if you subscribe to DrillUp as a consumer – that is, wholly or mainly for purposes outside any trade, business, craft or profession (for example, if you are an unpaid, amateur or volunteer coach subscribing for your own interest or development rather than as part of a coaching business).
The law gives consumers rights that cannot be excluded or restricted by contract. If you are a consumer, the rights in this Part B apply to you instead of the default position in Part A, to the extent they are more favourable to you. If you believe you are a consumer, please let us know at info@drillup.co.uk so that we can apply the correct terms to your subscription.
B1. Your 14-day right to change your mind (cooling-off period)
As a consumer, you have a legal right to cancel your subscription within 14 days of the date we confirm your subscription, without giving any reason. This is your statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Important: how you can lose this right
DrillUp provides digital content. If you ask us to start providing the digital content to you during the 14-day cooling-off period, and you acknowledge that you will lose your right to cancel once it begins, then you will lose your right to cancel as soon as access to the content starts.
Before you subscribe, we will ask you to confirm the following (or words to similar effect):
“I want my access to DrillUp’s content to start now, during the 14-day cancellation period, and I understand that I will lose my right to cancel and obtain a refund once access has started.”
If you do not give this confirmation, your access will not start until the 14-day period has ended, or you may cancel within the 14 days and receive a full refund.
B2. How to exercise your right to cancel
To cancel within the cooling-off period, you must tell us clearly that you have decided to cancel before the 14-day period ends. You can do this by contacting us at info@drillup.co.uk / using the cancellation form available at the bottom of this document. You may use the model cancellation wording at the end of this Policy, but you do not have to.
B3. Refunds for consumers

If you cancel within the 14-day period and your access to the content has not yet started, you will receive a full refund.

If you agreed that your access could start during the 14-day period (see B1) but had not yet lost your right to cancel, we may deduct an amount in proportion to the service used up to the point you told us you wanted to cancel.

Once your access to the digital content has started following your agreement and acknowledgement under B1, you no longer have a right to cancel under the cooling-off rules and no refund is due on that basis.
We will make any refund due using the same payment method you used to subscribe, and within 14 days of the day on which you told us you wished to cancel.
B4. Your rights if something is wrong with the App

Separately from your right to change your mind, the Consumer Rights Act 2015 gives you rights if the digital content we supply is not as described, not of satisfactory quality, or not fit for purpose. In those circumstances you may be entitled to a repair or replacement and, if that is not possible or does not resolve the problem, to some or all of your money back. If digital content we supply damages your device and we have not used reasonable care and skill, you may also be entitled to a repair or compensation.

These rights are in addition to your right to change your mind and are not affected by it. For more information about your rights, visit the Citizens Advice website at www.citizensadvice.org.uk.
Part C – Purchases made through the Apple App Store or Google Play

If you subscribe to DrillUp through the Apple App Store or Google Play, your subscription is billed by Apple or Google and is also subject to their terms, including their own cancellation and refund rules.

To cancel an auto-renewing subscription bought through Apple or Google, you generally need to do so through your Apple ID or Google account settings, not just within the App.

Refund requests for purchases made through Apple or Google are usually handled by Apple or Google under their own refund policies, and we may not be able to issue a refund directly for those purchases.

Where the law gives you cancellation or refund rights as a consumer (Part B), those rights continue to apply. If you have difficulty obtaining a refund through Apple or Google in a case where you are entitled to one, please contact us at info@drillup.co.uk and we will help.
4. Changes to this Policy

We may update this Policy from time to time. If we make material changes, we will notify you through the App before they take effect. The version that applied when you subscribed or last renewed will continue to govern that subscription period.
